Federal Shariat Court (Pakistan) declares women’s right to khula as absolute

In a significant development for women’s rights in Pakistan, the Federal Shariat Court (FSC) has declared that the right of khula, as granted to women by the Holy Quran and Sunnah, is an absolute and unique prerogative. Khula refers to the Islamic practice where a woman can initiate divorce by approaching a court.

The FSC’s ruling reaffirms the principle that women have the unequivocal authority to dissolve a marriage at their discretion, reflecting a progressive interpretation of Islamic law. This decision is a crucial step towards empowering women in the country, allowing them to exercise greater autonomy over their personal lives and marital relationships.

The FSC’s recognition of the absolute right to khula is a significant milestone in the ongoing evolution of women’s rights and gender equality within Pakistan. It aligns with the broader global movement advocating for women’s empowerment and underscores the importance of interpreting religious and legal principles in ways that promote gender equity and justice.
